These Terms of Service and Sale (“Terms”) govern your access to and use of:
effectivehappinessjournal.com and any pages we operate (the “Website”),
our Shopify store and checkout (the “Store”), and
the Effective Happiness Journal web application hosted at journal.effectivehappinessjournal.com (the “App”),
and any products or services offered through them, including physical journals/books (“Physical Products”), digital downloads such as PDFs (“Digital Products”), and subscriptions/memberships (“Subscriptions”). The Website, Store, App, and products/services are collectively the “Services”.

By accessing or using the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old (or the age of majority where you live) to purchase from the Store or use the App. If you are under the age of majority, you may use the Services only with a parent/guardian’s consent and supervision.
The Services are not intended for children.
We may update these Terms or the Services at any time. Changes are effective when posted on the Website (or as otherwise stated). Your continued use after changes means you accept the updated Terms.
We may modify, suspend, or discontinue any part of the Services at any time, including features, content, or availability.
To use the App, you may need to create an account. You agree to:
Provide accurate information and keep it updated.
Maintain the confidentiality of your login credentials.
Notify us immediately of unauthorized access.
You are responsible for all activity under your account.
We may suspend or terminate accounts that violate these Terms.
The Services and content (including prompts, templates, methods, and educational materials) are provided for informational and self-improvement purposes only.
They are not medical advice, mental health advice, therapy, diagnosis, treatment, or a substitute for professional services (medical, psychological, legal, accounting, or financial). Always seek the advice of qualified professionals regarding any health or personal situation. If you are experiencing an emergency, contact local emergency services.
Results are not guaranteed. Your outcomes depend on many factors, and individual results vary.
We try to display product descriptions and images accurately. However, we do not guarantee that colors, textures, or appearance shown on your screen match the physical product exactly.
Prices are shown in CAD. We may change prices at any time. Taxes, shipping, and fees may be added at checkout.
Payments are processed by third-party payment processors (e.g., Shopify Payments and/or other providers). We do not store full payment card details. Your payment is subject to the processor’s terms and privacy policy.
An order is not accepted until we confirm it (email confirmation or shipment confirmation). We may refuse or cancel any order in our discretion (e.g., suspected fraud, inventory issues, pricing errors). If we cancel after you are charged, we will issue a refund for the amount paid for the canceled order.
Shipping times are estimates and not guaranteed. Delays can occur due to carriers, customs, weather, or other events outside our control.
Risk of loss and title pass to you upon delivery to the carrier (unless your local law requires otherwise).
International customers may be responsible for duties, taxes, and customs fees.
Digital Products are delivered electronically (e.g., download link or email). You are responsible for downloading and storing your Digital Product. We are not responsible for issues caused by your device, software, internet connection, or inability to access files due to unsupported formats.
Digital Products are licensed, not sold, under the Digital Products License (see Section 15). You may not share, redistribute, resell, publicly post, or otherwise exploit Digital Products except as expressly permitted.
If you purchase a Subscription, it will auto-renew at the end of each billing period unless you cancel before renewal. You authorize us (and our payment processors) to charge your payment method for recurring fees.
If a free trial or promotional period is offered, the Subscription will automatically convert to paid unless canceled before the end of the trial/promo period.
You can cancel by:
using the in-app billing/settings page (if available), or
contacting us at support@effectivehappinessjournal.com with your account email and request to cancel.
Cancellation stops future renewals. Access may continue until the end of the current paid period unless stated otherwise.
Subscription fees are non-refundable and we do not provide prorated refunds for partial periods, except where required by law or as otherwise stated in a written policy.
We may change Subscription pricing. If required by law, we will provide notice before the new price takes effect.
If you place a preorder, you authorize us to charge your payment method as described at checkout (immediately or at fulfillment). Estimated ship dates are not guaranteed. Preorders may be canceled per our Refund/Returns Policy, subject to local law.
“User Content” includes anything you submit through the Services, including journal entries, goals, notes, and files.
You retain ownership of your User Content. By submitting User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and use your User Content solely to operate, maintain, and improve the Services and to provide them to you.
You are responsible for your User Content and represent that you have the rights to submit it.
Do not submit highly sensitive personal information (e.g., medical records, government IDs) unless you accept the risks of storing such data online.
You agree not to:
Violate any law or third-party rights.
Attempt to gain unauthorized access to systems or accounts.
Reverse engineer, scrape, or interfere with the Services.
Upload malware or harmful code.
Use the Services to harass, abuse, or harm others.
We may suspend or terminate access for violations.
The Services, including all content, designs, templates, text, graphics, logos, UI, and underlying software, are owned by us or our licensors and protected by intellectual property laws.
Effective Happiness Journal, The Golden Thread, and all related names, marks, and logos are trademarks and/or trade dress of the Company (or are used under license). You may not use our marks without our prior written permission.
No rights are granted except as explicitly stated.
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.
The Services may integrate with third-party services (e.g., Shopify, analytics tools, email providers). We are not responsible for third-party services, and your use of them may be subject to their terms and privacy policies.
Subject to these Terms and your payment, we grant you a personal, non-exclusive, non-transferable, revocable license to:
download and use the Digital Product for your personal use, and
print copies for your personal use (if the product is designed to be printable).
You may not:
share or distribute the file (free or paid),
upload it publicly (including social media, Google Drive links, torrents, etc.),
resell, sublicense, or bundle it,
remove watermarks/copyright notices,
create derivative products for commercial use.
We may revoke this license if you violate these Terms.
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, secure, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS WILL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID TO US FOR THE SERVICES/PRODUCTS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR
(B) $100 USD.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.
We may terminate or suspend your access to the Services at any time, with or without notice, if we believe you violated these Terms or if required to protect the Services or others.
Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination will survive (including IP, disclaimers, limitation of liability, indemnity, and dispute terms).
These Terms are governed by the laws of Canada, without regard to conflict-of-laws rules.
Before filing a claim, contact us at support@effectivehappinessjournal.com and we’ll try to resolve it.
Severability: If any provision is unenforceable, the rest remains in effect.
Assignment: You may not assign your rights; we may assign ours.
Entire Agreement: These Terms and any policies referenced form the entire agreement.
